NeftX is the author and publisher of the internet resource www.neftx.com (“Website”) on the World Wide Web as well as the software and applications provided by NeftX, (together with the Website, referred to as the “Services”).

This policy ("Privacy Policy") explains how we collect, use, disclose and protect Personal information about the Users of the Services. We have created this Privacy Policy to demonstrate our commitment to the protection of your privacy and your personal information. This privacy policy applies to anyone who interacts with us in relation to our products and services via any channel (e.g. website, email, phone, walk-ins via white-labelled NeftX products etc.).Any capitalized term used but not defined in this Privacy Policy shall have the meaning attributed to it in our Terms And Conditions.

BY USING THE SERVICES OR BY OTHERWISE GIVING US YOUR INFORMATION, YOU WILL BE DEEMED TO HAVE READ, UNDERSTOOD AND AGREED TO THE PRACTICES AND POLICIES OUTLINED IN THIS PRIVACY POLICY AND AGREE TO BE BOUND BY THE PRIVACY POLICY. YOU HEREBY CONSENT TO OUR COLLECTION, USE AND SHARING, DISCLOSURE OF YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY. IN CASE YOU DO NOT AGREE TO OUR POLICY, DO NOT USE ANY OF THE SERVICES OR GIVE US ANY OF YOUR INFORMATION.

“You", “Your”, or “User” means any natural or legal person who uses the Website for availing services offered by the Website (“Services”).

  1. WHY THIS PRIVACY POLICY?
  2. This Privacy Policy is published in compliance with, inter alia:

    1. Section 43A of the Information Technology Act, 2000;
    2. Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”);
    3. Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.

    This Privacy Policy covers: (i) the type of information collected from the users through the Website including sensitive personal data or information; (ii) the purpose, means and modes of usage of such information; and (iii) How and to whom NeftX will disclose such information

  3. COLLECTION OF PERSONAL INFORMATION

When you access the Services or through any interaction with us via registration, emails, telephone calls or other correspondence, we may ask you to voluntarily provide us with certain information that personally identifies you or could be used to personally identify you.     The information collected from you by NeftX may constitute ‘personal information’ or ‘sensitive personal data or information’ under the SPI Rules.

    For the purpose of this Privacy Policy, “Personal Information” as defined under Section 2(i) of the SPI Rules means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person.

    Section 3 of The SPI Rules further define “Sensitive Personal Data or Information” of a person to mean personal information about that person relating to:

    1. passwords;
    2. financial information such as bank accounts, credit and debit card details or other payment instrument details;
    3. physical, physiological and mental health condition;
    4. sexual orientation;
    5. medical records and history;
    6. biometric information;
    7. detail relating to the above clauses as provided to body corporate for providing service; and
    8. any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise:

    NeftX will be free to use, collect and disclose information that is freely available in the public domain without your consent.

  5. USE OF INFORMATION COLLECTED
  6. 3.1 Our primary goal in collecting your information is to provide you with an enhanced experience when using the Services.

    3.2 Based upon the Protected Information you provide us when registering for an account, we will send you a welcoming email to onboard you on our service.

    3.3 We might send you an email strictly related to our service or announcements on rare occasions when it is necessary to do so.

    3.4 We may use the information obtained from you to prevent, discover and investigate violations of this Privacy Policy or any applicable terms of service.

  8. 4.1 NeftX takes all necessary precautions to protect your personal information and have implemented reasonable security practices and measures including certain electronic, managerial, technical, operational and physical security control measures that are commensurate with respect to the information being collected and the nature of NeftX’s business. The protection is provided against unauthorised access, improper use or disclosure, unauthorised modification and unlawful destruction or accidental loss.

    4.2 Your Personal Information is maintained by NeftX in electronic form on its equipment, and on the equipment of its employees. Such information may also be converted to physical form from time to time, if required.

    4.3 No administrator at NeftX will have knowledge of your password. It is important for you to protect against unauthorized access to your password, your computer and your mobile phone. Be sure to log off from the Website when finished. Neftx does not undertake any liability for any unauthorised use of your account and password. If you suspect any unauthorized use of your account, you must immediately notify NeftX by sending an email to support@neftx.com. You shall be liable to indemnify NeftX due to any loss suffered by it due to such unauthorized use of your account and password.

    4.4 We may provide links to websites for the convenience and information of users. These websites may not be owned, controlled, or operated by us. In those cases, we cannot control how information collected by those websites will be used, shared, or secured. If the user visits linked sites, we strongly recommend that the user reviews the privacy notices or policies posted at those sites. We are not responsible for the content of linked sites, the user’s use of them, or the information practices of their operators.

    4.5 NeftX makes all User information accessible to its employees, agents or partners only on a need-to-know basis, and binds only its employees to strict confidentiality obligations.

    4.6 Notwithstanding the above, NeftX is not responsible for the confidentiality, security or distribution of your Personal Information by our partners and third parties outside thescope of our agreement with such partners and third parties. Further, NeftX shall not be responsible for any breach of security or for any actions of any third parties or events that are beyond the reasonable control of NeftX including but not limited to, acts of government, computer hacking, unauthorised access to computer data and storage device, computer crashes, breach of security and encryption, poor quality of Internet service or telephone service of the User etc.

    4.7 Although we will endeavour to safeguard the confidentiality of your information, transmissions made by means of the Internet cannot be made absolutely secure. No such measures are competent enough to safeguard your information in a complete 100% way. Hence, you are also encouraged to take steps to prevent your information from being misused by logging off after using a shared computer, choosing a robust password, not sharing the password with anyone and changing it periodically. We in no way are to beheld responsible for the unauthorized use of your information or for any suspicious activity on your account. By using our Platform, you agree that we will have no liability for disclosure of your information due to errors in transmission or unauthorized acts of third parties.

  9. SHARING / DISCLOSURE OF PERSONAL INFORMATION
  10. 5.1 All financial information like User’s credit/debit card numbers, bank account numbers, bank names that is collected through the Website is used solely to bill and pay for the services availed by the user, and is not used for marketing or promotional purposes. User’s credit-card/debit card details are transacted upon secure sites of approved payment gateways which are digitally under encryption, thereby providing the highest possible degree of care as per current technology. Towards this end, we disclose such information to a third-party intermediary, for the sole purpose of payment processing, which is used to make payments to avail the services on our Website.

    5.2 We reserve the right to access, monitor, use or disclose any personal information or communications as required by law and when we believe, at our sole discretion that disclosure is necessary to protect our rights, comply with the law or respond to lawful requests, protect someone from injury and/or to comply with a judicial proceeding, court order, or legal process served on our Website.

NeftX also receives the Internet Protocol (IP) address of each User’s computer (or the proxy server a User used to access the World Wide Web), User’s computer operating system and type of web browser the User is using, email patterns, as well as the name of User’s ISP. This information is used to analyze overall trends to help NeftX improve its Service. The linkage between User’s IP address and User’s personally identifiable information is not shared with or disclosed to third parties.

We will post the new privacy policy on the website and update the "Last updated" date at the top of this page. We will display a notice on the Website, or notify the Users through an email, in case of anychange/update, so that you may review the changed terms prior to continuing to use the Services.

    8.2 If a User uses the Services or accesses the Website after a notice of changes has been sent to such User or published on the Website, such User hereby provides his/her/its consent to the changed terms.

    8.3 In case you object or do not agree to any of the changes to our terms, do not use any of the services or give us any of your information. If you no longer wish to use the Services, you may contact support@neftx.com to deactivate your account. Unless stated otherwise, our current Privacy Policy applies to all information that Neftx has about you and your account.

  17. RETENTION OF INFORMATION
  18. We will retain your information for as long as your account with the Services is active and as needed to provide you the Services. If you wish to cancel your account or request that we no longer use your information to provide you Services, contact us through support@neftx.com. We shall not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force. After a period of time, your data may be anonymized and aggregated, and then may be held by us as long as necessary for us to provide our Services effectively, but our use of the anonymized data will be solely for analytic purposes. Please note that your withdrawal of consent, or cancellation of account may result in NeftX being unable to provide you with its Services or to terminate any existing relationship NeftX may have with you. In case of termination of user accounts, the information remain with us for a reasonable time, however, the same cannot be accessed by you.

  21. GOVERNING LAW AND JURISDICTION
  22. The Privacy Policy shall be governed by and constructed in accordance with the applicable laws of India without reference to conflict of laws principles. Courts in Hyderabad, Telangana shall have the exclusive jurisdiction to determine any disputes arising in relation to, or under, this Privacy Policy.
